Meet Gary N. Holthus, Attorney and Counselor at Law.
Gary was recently recognized with distinction by the Florida Bar for his 50 years of membership in the Florida Bar.
During Gary’s 50 years of practice, he proudly held marital and family law board certification from 1986 to 2021. Many cases that Gary handled were heavily litigated and contained complex issues.
In addition to also handling contracts, corporations, probate, and real estate cases, he has practiced sports law for over 40 years.
Gary's vast experience in litigation, advising, evaluating, and negotiating clients’ legal matters provides valuable knowledge and strategies to his clients.
With more than 50 years of courtroom and legal knowledge and experience, Mr. Holthus will advise and counsel you through the Florida legal process.
Counselor at Law versus Attorney at Law:
Like many counselor-client relationships, the client has a need and is seeking the knowledge and advice of the counselor to improve their skills, actions, performance in the future, and to present or avoid negative matters in the future. Although the counselor is a member of the Florida Bar and can represent the client in legal proceedings as the client's advocate, it is generally not the role of the counselor at law and is acting as the client's advisor.
Conversely, the attorney at law is sought out by the client to address the legal matters resulting from the client's past actions and conduct. Although the attorney at law may counsel their client, the role of the attorney is to be the client's legal advocate in dealing with the legal matters from the client's past actions
Finally, generally due to the many factors involved in the legal process, the attorney at law will have a higher fee structure and retainer than the counselor at law.
Family Mediation:
Mr. Holthus has been counsel for numerous clients at family law mediations and is currently a certified family mediator by the Supreme Court of Florida.
Family law cases are required to go through court-ordered mediation before a final hearing can be set.
The mediation process is conducted with both parties before a mediator and is confidential. The mediator conducts the process in accordance with Florida state laws and rules, in an effort to reach a voluntary agreement of all or part of the issues in the case.
During the mediation, the parties, their counsel, and the mediator may remain in the same room. However, if the parties desire to discuss certain matters with the mediator they can go to separate rooms for what is called a “caucus.”
In the event all of the issues are resolved a full agreement along with the signed mediation agreement is filed with the court and a final hearing scheduled. If not, an “impasse” is filed with the court and a final contested hearing is scheduled.
